The new law being passed will cover nearly all employers regardless of size or success. The new law clearly states that once and employee works at least a month, an employer is required to provide that employee with at least one hour of sick leave for every 30 hours worked. This new law also applies to out of state employers that have employees working in the state of California. For employees that also receive commission in addition to their normal wages, the commissions must be factored into their sick leave pay. The new law may also mean that some employers must modify their existing policies in order to act in accordance with the new law. The new rules and regulations must be made available to employees via written notice, which will explain every employee’s right to use sick leave throughout their time with the company. Employers will also need to display posters in common and frequently used areas that provide information about the new sick leave laws as well. Employers will also be required to keep records to up to three years regarding employee sick leave. This includes hours worked, accrual, and utilization of paid sick leave hours. A failure to maintain these records on the part of the employer will result in the assumption that the employee has accrued the maximum number of hours, unless clearly proven otherwise.
